TERMS OF USE: MapSur Last updated: May 1, 2026, Version 2.4 ━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━ PREAMBLE These Terms of Use govern access to and use of the MapSur mobile application, published by Merta (SIRET: 103 063 657 00011). MapSur is a community application for travel reviews and destination safety assessment, intended for travelers who wish to learn about the safety level and welcome of a destination. It relies on official public data, community reviews, and estimates generated by artificial intelligence. Using MapSur does not replace local authority guidelines, official travel advisories, or the user's personal judgment. ━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━ ARTICLE 1: PURPOSE MapSur offers the following features: • Community travel reviews filterable by profile (ethnicity, gender, orientation, religion, disability, travel style) • Indicative safety scores based on official data • Trip planning with seasonal analysis and AI estimation • Enriched destination pages (reviews, statistical indicators, LGBTQ+ rights) • Saved destinations ━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━ ARTICLE 2: ACCEPTANCE OF TERMS Registration and use of the Service implies full acceptance of these Terms. By creating an account, the user acknowledges having read and accepted these Terms without reservation. ━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━ ARTICLE 3: REGISTRATION AND USER ACCOUNT 3.1 Registration requirements • Be at least 16 years old (MapSur-chosen threshold, stricter than the 15-year digital consent age in French law) • Provide a valid email address • Provide accurate and up-to-date information 3.2 Credentials The user chooses a username visible to other users. This username must not: • Impersonate another person • Contain insulting or discriminatory language • Reproduce a registered trademark 3.3 Account security The user is responsible for keeping their credentials confidential. Any activity from their account is presumed to be performed by them. In case of unauthorized use, notify Merta immediately. 3.4 Traveler profile (optional) The user may fill in a traveler profile including sensitive data (ethnicity, gender, orientation, religion, disability). This profile is entirely optional and subject to explicit consent (GDPR Art. 9). The user can delete it at any time. ━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━ ARTICLE 4: DESCRIPTION OF THE SERVICE 4.1 What MapSur does MapSur is a decision-support tool that aggregates: • Community travel reviews filterable by identity profile • Official public data (police, government institutions, international organizations) • Artificial intelligence estimates (Google Gemini), clearly labeled The safety score is composite: local data, city data, national indicators, travel advisories. Data quality is indicated (high, medium, low, absent). 4.2 What MapSur does NOT do MapSur is not: • A security or surveillance service • Professional security advice • An emergency service • An official security source • A substitute for official travel advisories • A guarantee that "safe" locations are actually safe 4.3 Availability The Service may be temporarily suspended for maintenance or force majeure, without compensation. 4.4 Pricing All features are offered free of charge. Paid features may be introduced in the future. ━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━ ARTICLE 5: COMMUNITY CONTENT 5.1 Travel reviews Users can publish reviews about destinations they have visited. Each review includes: an overall rating, category ratings (welcoming, safety, inclusivity, accessibility), a title, text, and optional practical tips. 5.2 Review guidelines Reviews must: • Be sincere and in good faith (fake reviews prohibited) • Be based on a real personal experience • Not contain personal data of third parties • Not be defamatory, insulting, or discriminatory • Not contain illegal content • Not be misused (spam, advertising, propaganda) 5.3 Trust score Each user receives an automatic trust score based on their activity. It is used internally to weight contribution reliability. 5.4 Moderation and sanctions In case of violation: content removal, warning, trust score reduction, temporary suspension, or permanent account deletion. 5.4.1 Notice-and-action procedure (DSA and LCEN) In accordance with Regulation (EU) 2022/2065 (DSA, Article 16) and the French LCEN (law on confidence in the digital economy), any user or third party may report content they consider illegal or in breach of these Terms. How to report: • In-app: the "Report" button available on each review or comment. • By email: contact@mapsur.com with subject line "Content report". Useful information to include in a report: • Link or ID of the reported review/profile. • Specific grounds (hate speech, defamation, privacy breach, illegal content, etc.). • Contact details of the reporter (for acknowledgment of receipt), optional but recommended. Processing: • MapSur acknowledges receipt within 48 business hours when the reporter has provided contact details. • MapSur may request additional information to assess the report. • Manifestly illegal content is removed or masked without delay. • Other reports are subject to adversarial review; the content author may be consulted. • The reporter, and where applicable the content author, are informed of MapSur's reasoned decision. Single point of contact (Art. 11 DSA): contact@mapsur.com 5.5 Derivative uses of reviews ("Places of interest" feature) If you publish a review while ticking the "Show my traveler profile with this review" option AND your overall rating is at least 4 out of 5, MapSur may reuse the content of that review to power the "Places of interest" feature, which publicly recommends venues (neighborhoods, restaurants, nightlife, cultural spots) sorted by traveler identity profile on destination pages. How it works: • MapSur automatically parses your review body to detect mentions of known places and explicit profile cues (e.g. "as a solo female traveler", "as a hijabi"). • Matched venues may be displayed publicly on the destination's Places of interest pages, together with a short exact quote from your review as justification. • Every recommendation keeps a clickable link back to your original review. • No AI generation is involved: only exact excerpts from your text may appear. Participation conditions: No derivative processing occurs unless all of these are true: • The review shows your traveler profile ("Show my profile" ticked at publication time). • The review's overall rating is at least 4 out of 5. Withdrawal at any time: You keep full control over these derivative uses: • Editing your review (from "My reviews") automatically updates the derived recommendations. • Deleting your review immediately and permanently deletes all Places of interest recommendations derived from it (GDPR Art. 17: right to erasure). • Unchecking "Show my profile" on an existing review also removes the derived recommendations (GDPR Art. 7(3): withdrawal of consent). • Deleting your account triggers review anonymization (Article 10) and removal of any recommendation that might contain identifying elements. This feature relies on your distinct consent, expressed at publication time by ticking "Show my traveler profile" (Art. 6(1)(a) GDPR), combined with the explicit consent already given for the sensitive data in your traveler profile (Art. 9(2)(a) GDPR). You may withdraw this consent at any time via the mechanisms described above (Art. 7(3) GDPR). You are informed of this processing in the present clause and in section 4.3 of the Privacy Policy. 5.6 Affiliate links MapSur includes on its pages affiliate links pointing to third-party travel partners (hotels, activities, insurance), clearly identified as "Sponsored links" / "Liens partenaires" in immediate proximity. If you make a booking with a partner after clicking such a link from MapSur, MapSur may earn a commission from the partner. This commission is paid directly by the partner and entails no extra cost to you. MapSur is not a party to the sale contract concluded between you and the partner. The booking, its execution, payment, cancellation, warranties, and any disputes are governed exclusively by your relationship with the partner under the partner's general terms. MapSur does not warrant the quality, availability, or pricing of products or services offered by partners, and cannot be held liable for any default, delay, or improper performance attributable to the partner. Details of the associated data processing (UTM parameters, "affiliate_clicked" event, no personal data transmitted) are described in section 4.8 of the Privacy Policy. ━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━ ARTICLE 6: SAFETY SCORE AND ARTIFICIAL INTELLIGENCE 6.1 Indicative nature The safety score is a statistical indicator for informational purposes only. It does not constitute: • A guarantee of safety or danger • An official advisory from a public authority • Personalized travel advice • A comprehensive risk assessment 6.2 Data limitations • Public data: possible time lag (months or years) • Community reviews: subjective perception, not verified before publication • Uneven geographic coverage depending on available sources • Absence of reviews in an area does not mean absence of risk • A high score does not constitute a safety guarantee • Data quality is indicated to the user (high, medium, low, absent) 6.3 AI estimates Estimates generated by artificial intelligence: • Are clearly labeled ("AI Estimate") • Are cached for 30 days only when they are not personalized by profile • Are based on general knowledge (not real-time) • May contain inaccuracies or biases • Do not replace official advisories 6.4 Data sources MapSur presents statistical data from official public sources (police services, government institutions, international organizations) and community reviews. The publisher does not produce this data and cannot guarantee its accuracy, completeness, or timeliness. 6.5 User responsibility The user is solely responsible for their travel and movement decisions. MapSur does not replace emergency services, law enforcement, or official travel advisories. It is strongly recommended to consult your country's official travel advisories before any trip. ━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━ ARTICLE 7: INTELLECTUAL PROPERTY The MapSur application, its code, architecture, algorithms, and graphic elements are the property of Merta. The user retains ownership of their contributions but grants a non-exclusive, free, worldwide license for their use within the Service. Public data (open data) is subject to its respective licenses. ━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━ ARTICLE 8: PERSONAL DATA The processing of personal data is described in the Privacy Policy, accessible in the app (Profile > Settings > Privacy Policy). The user has rights of access, rectification, erasure, portability, restriction, and objection (GDPR). ━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━ ARTICLE 9: LIMITATION OF LIABILITY MapSur is a general information tool and not a security, emergency, or professional advisory service. The publisher shall not be held liable for: • Decisions made based on provided information • Inaccuracy of scores, AI estimates, or community reviews • Incidents occurring in a location displayed as "safe" or with a high score • Damages related to Service unavailability • Absence of reviews in an area with actual risks • Consequences of using AI-generated estimates Community reviews express the personal experiences of their authors. The publisher is not responsible for review content. In accordance with French digital law (LCEN) and the Digital Services Act (DSA), the publisher acts as a host for community reviews and commits to removing any manifestly illegal content upon notification. ━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━ ARTICLE 10: ACCOUNT DELETION 10.1 At the user's initiative Available in the app (Profile > Settings > Delete my account). Consequences: • Deletion of personal data within 30 days • Anonymization of published reviews (username removed, reviews remain) • Deletion of traveler profile and history 10.2 At Merta's initiative Possible in case of Terms violation or prolonged inactivity (> 24 months), after prior notification. ━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━ ARTICLE 11: CHANGES TO TERMS For substantial changes: notification in the app and/or by email at least 30 days in advance. Continued use after this period constitutes acceptance. Minor changes: without prior notification. ━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━ ARTICLE 12: GOVERNING LAW These Terms are governed by French law. In case of dispute, parties commit to seeking an amicable solution. Should MapSur ever offer a paid service, EU-resident consumer users would be entitled to free consumer mediation under Articles L. 611-1 et seq. of the French Consumer Code. As of today, MapSur is free and offers no paid service.
